Eligibility: You must be a resident of in the UNITED STATES to win. You must be 18 years of age or older to be eligible. Special only applies to online customers of Tallman Equipment at this time.
Agreement to Rules: By participating, the Contestant (“You”) agree to be fully unconditionally bound by these Rules, and You represent and warrant that You meet the eligibility requirements. In addition, You agree to accept the decisions of Tallman Equipment Company as final and binding as it relates to the content of this sweepstakes.
Campaign Period: Orders or submissions placed online between 12:00 am (EST) October 17, 2024 and 11:59 pm (EST) October 31, 2024 are eligible, while supplies last. Not valid for submissions made outside this time frame. Supplies may be depleted before the end of the promotional time period.
Prizes: Prizes have been provided either in full or in part by the following sponsors: Madi Tools, Klein Tools, Harrington Hoists, DDIN, GoLight, GroundGuards, Bashlin, Apex/Crescent Tools, and Tallman Equipment.
The prize is nontransferable. Any and all prize-related expenses, including without limitation any and all federal, state, and/or local taxes, shall be the sole responsibility of the Winner. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by Winner is permitted. The prizes listed below will be randomly awarded on November 1, 2024 based on the entries received during the promotional period. The Mystery Prize Bundles sent to every web order equal to or above $200.00 (before tax and shipping) will contain at least (1) Meshback Hat from either DDIN, GroundGuards, or Madi Tools.)

Winners: At the conclusion of the sweepstakes, winners will be drawn randomly from the eligible web orders and manual entries submitted during the Sweepstakes Period. Winners will be notified of their winnings by phone or email no later than November 5, 2024.
How to Enter: Web orders over $200 (before tax and shipping) automatically receive a Mystery Prize Bundle, which includes a hat. All web orders placed during the promotional period will also be entered into a drawing for a chance to win one of the remaining prizes not included in the Mystery Bundle. For every $10 (before tax and shipping) spent, entrants will receive (1) entry into the prize drawing. For example, an order with a subtotal of $19.83 will be given 1 entry.
Manual Entry: To enter without making a purchase, Entrant must complete and submit this form during the Sweepstakes Period in its entirety. Then, click the “Submit” button to receive one (1) entry into the Sweepstakes. All manual entries must be received by 11:59:59pm EST on October 31, 2024. No purchase necessary to enter. You may submit the form an unlimited number of times during the sweepstakes period. Tallman reserves the right to disqualify and cancel any manual entry prize winners where it seems these rules may have been violated.
Void where prohibited. If You use fraudulent methods or otherwise attempt to circumvent the rules, your submission may be removed from eligibility at the sole discretion of Tallman Equipment Company.
Odds: All web orders equal to or in excess of $200 before tax and shipping and placed during the promotional period will receive a Mystery Prize Bundle. Odds of winning one of the prizes drawn at the end of the promotion depend on the number of eligible entries received during the Sweepstakes Period. No purchase necessary to win.
Rights Granted by You: By entering, you understand and agree that Tallman Equipment, anyone acting on behalf of Tallman Equipment, and Tallman Equipment licensees, successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the World, without limitation, your entry, name, portrait, picture, likeness, image, statements about the Contest, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes without any further compensation, notice, review, or consent.
By entering this content, You represent and warrant that your entry is an original work of authorship, and does not violate any third party’s proprietary or intellectual property rights. If your entry infringes upon the intellectual property right of another, You will be disqualified at the sole discretion of Tallman Equipment Company. If the content of your entry is claimed to constitute an infringement of any proprietary or intellectual proprietary rights of any third party, You shall, at your sole expense, defend or settle against such claims. You shall indemnify, defend, and hold harmless Tallman Equipment Company from and against any suit, proceeding, claims, liability, loss, damage, costs, or expense, which Tallman Equipment Company may incur, suffer or be required to pay to arise out of such infringement or suspected infringement of any third party’s right.
Terms & Conditions: Tallman Equipment Company reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Contest should virus, bug, non-authorized human intervention, fraud, or other cause beyond Tallman Equipment Company’s control corrupt or affect the administration, security, fairness, or proper conduct of the Campaign. In such case, Tallman Equipment Company may select the Winner from all eligible entries received prior to and/or after (if appropriate) the action taken by Tallman Equipment Company. Tallman Equipment Company reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Contest or website or violates these Terms & Conditions. Tallman Equipment Company has the right, in its sole discretion, to maintain the integrity of the Contest, to void votes for any reason, including, but not limited to: multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by Campaign rules; or the use of bots, macros, scripts, or other technical means for entering. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Campaign may be a violation of criminal and civil laws. Should such an attempt be made, Tallman Equipment Company reserves the right to seek damages to the fullest extent permitted by law.
Limitation of Liability: By entering, You agree to release and hold harmless Tallman Equipment Company and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) such entrant’s participation in the Contest and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; (v) electronic or human error in the administration of the Promotion or the processing of entries.
Disputes: THIS Campaign IS GOVERNED BY THE LAWS OF The State of Indiana WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Contest, the participant agrees that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Contest, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Indiana having jurisdiction. Further, in any such dispute, under no circumstances shall participant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than participant’s actual out-of-pocket expenses (i.e. costs associated with entering this Campaign). Participant further waives all rights to have damages multiplied or increased.
